GM Facing Class Action Lawsuit Over Lifters

A recall won't make the lawyers any money and it would cost the manufacturer a lot of money. A settlement will save GM millions and make the lawyers millions. GM saves face, the lawyers buy an island, and the customer gets screwed. If you were the lawyer or the manufacturer, which option would you choose?

 

Right, but I'm just relaying what the article states. They could take a settlement in the end. I don't know anything about class action lawsuits, though.

 

If I were either of the latter in that situation you posed it's obvious what I would choose, however since I'm the customer and I am aware of those parties seeking that outcome for their own gain I would personally opt for a recall. The lawyers, at least I'm assuming in a class action lawsuit, are at the direction of their clients as the final word. It wouldn't be the first time a class action lawsuit has led GM to issue a recall on these trucks.

It seems with the vacuum pump issues the cases were dismissed once GM issued the recall, though there are more individual cases still pending I believe.

Back when I was living in the Ford 5.4 Triton world, switching from 5w-20 to 5w-30 was deemed beneficial to the engine considering the phaser and tensioner failures.  A few years ago I'd posed the oil upgrade question here with regards to the 5.3, and at the time, switching to 5w-30 brought negative, "don't do it" responses.  It seems time and knowledge has been gained in that time; with the 4.3 and the V8s in the cars using 5w-30, I see valid reasons for switching from 0w-20, other than the cold-start viscosity of 0w vs 5w.  On my daily driver, there is a definite cold-start difference (noted by changes in metal particulate in the UOAs) between 0w and 5w.  A 0w-30 would be perfect for me.  The warranty on my '16 expires soon and I'm about to cross 99k miles, the engine quiet and smooth, and I'd like to keep it that way.

So, some people say it’s the oil some say it’s the part. When I had my Camry I’d check out the Toyota sites. More than a few testimonies saying up your oil to 5-30 for longevity. I’m thinking longer than what? All four of my vehicles all different brands say 0-20. I’m thinking it’s the part. My brother has had 3 Rams with cylinder deactivation. The oldest has over 200K no engine work. The second at 40K had lifter failure fixed under warranty. The last one is a year old. These cylinder deactivation vehicles just give  you something else to worry about.

Ya, your probably right. And if somehow it does finally settle in 8 years from now, every GM owner will get a check for $0.43 as their allotted settlement amount. The lawyers will get the other half of the 300 million dollar settlement.

In the attorneys defense, while yes, all attorneys would be better off wearing concrete shoes at the bottom of some substantial body of water, wading through the court swamps isn't easy work.

After being involved in two lawsuits involving patent issues and dealerships issues. Learning in the process that the law is complicated by design. And very expensive also by design. Although winning is very satisfying being made whole is the best you can expect. If you’re lucky. Shooting for a recall and extended warranty would be a big win.

Only if the problem is small and insignificant. They have in house lawyers I’m sure. If it’s a large problem a quick recall settlement with extended warranties will come faster. The time frame that really matters in reality is after the warranty period and 100K miles. After that it gets muddy. When buying extended warranty I followed the sticker they put on the window and used the dealer for maintenance. Something the (smart) people say screw that. I wonder how that   will bite  people in the buttocks.🤣. They are really getting creative with oils and maintenance schedule to mask a hardware problem. It’s about to bite them now.

Isn't the warranty 6 yrs or 100k? My '17 @ 40k miles is now out of warranty due to time.

Ok....mine is a Certified Used Truck...got the extra 40k miles, but no extra years from time of original put into service date. 1st thing I did was defeated  the AFM.

Might want to check that; my '16 CPO is 6 years/100k, the warranty expires October of 2022 on time.  I'm about to hit 99k miles, so I'll run out of miles sometime in the spring.

My bad, you're correct. My '17 CPO was put into service on 1/31/17 so 6 years would put me at 1/31/23! I have 1 more year! The sales manager actually wrote down 1/31/22. unless I put 60k miles on it in the next 12 months....that won't happen. Thanks

Uh i dont think anybody gave you any “don’t do it” responses.

 

the lt1 is the exact same motor with exact same lifters as the l86, and it calls for 5w30
