Personally, I would have said, "Its in the car".

 

The cop gives NO warning or instructions(that I could hear), that's probably what is going to kill his case.

 

Even in the grainy video, the body language of the guy isn't even close to aggressive, IMO.

 

And for reference, I imagine this will apply in this case.

Except for when I was seventeen and dumb, ive have been pulled over about four times since, I make it clear what im doing and why when a cop pulls me over. Sir, ok, im going to do this ok? I have to reach up here ok? Thank you for the warning, Ill do better next time. Its just plain dumb to piss off a cop.

I always wonder what cops think when I'm stopped they can't see in quite the dark tint and I'm grabbing the info before they even get to me so when they hit the window im already handing it to them never had one get scared on me before.. they usually just have shitty attitudes which is when.i start getting shitty. If their nice upon arrival then they get the same in return.

Being a cop I'm usually quick to defend them, but this is indefensible. Fortunately the guy lived. Although I fail to see a how a bad arrest, resulting from a lawful search, in Ohio matters here. The supreme court has ruled that a protective sweep of the reach, lunge, and grab area is permissible. Particularly when furtive movements are made. Now there must be some articulable and reasonable suspicion, much like a terry stop. But in the end, this Trooper's actions will be used to further demonize and condemn law enforcement as a whole. I'm sure Eric Holder has wood.

When the guy turned around, he had several second to yell some instructions. I'm not a cop, so all I have to go by is COPS, and I'm pretty sure every episode I have watched they yell at someone to stop moving before they start shooting. And if you read the article, it was deemed by a court that is was an UNlawful search in Ohio. It was making the rounds a few weeks ago.

 

As I said, I verbally broadcast my intentions the two times I have been pulled over(be 8 years next month since my last time).

Never done it that way. Stop, windows down, done light on if dark and hands at 10 and 2. Then I tell him/her everything I do before I do it ("My paperwork is in the console officer"). Been stopped 5-6 times since I turned 16 and only one ended in a speeding ticket.

I give mutual respect, if you're a prick I'll be a prick. I NEVER open my window all the way, I open it 1" just enough for me to hear them and pass them my shit. I keep my hands where they can see them and I don't do small talk. Yes sir, no sir..thank you sir.

That particular officer was jumpy as a tree frog. Not very good at self-preservation either, in my opinion. He came out from behind the cover of the car when he was apparently in fear. I don't think he shot the guy with malice. But he didn't do much right.

Seems like a bad way to go. The cop can be a prick, but I still try to be level. This isn't a pissing contest, nor is it about respect. It's about survival. The cop has a gun and if he's a prick, I don't want to piss him off any more. Ego or no ego, it just doesn't make any sense. I want to control the part of the situation I have control over to help it go in my favor. If there was ever any doubt in anyone's mind about whether a stop is about survival, this video pretty well clinches it.

X2, Windows down, lights on, hands in clear view at all times, loud clear direction of what I am doing if i do move at all, yes sir, no sir, the court system is a much better place to argue my point than on the side of the road.

I live in Canada where people actually have respect, and you don't gotta worry about getting shot. So now that we have that clear...

 

I do what I'm legally obligated to do and nothing more. I don't break any rules and I'm not rude. It's different here...you don't have to be afraid of dealing with a trigger happy degenerate of a cop in Canada. Generally they are nice people...and if you treat them with respect they do th same.
